تنشأ الدول نتيجة تكامل بين التطور التاريخي والاجتماعي والسياسي للشعب وبين تطوره القانوني . وهي توجد باجتماع ثلاثة عناصر مادية من إقليم وشعب وسلطة تؤدي الى قيام النظام القانوني والاجتماعي والاداري للدولة ، فلا يكفي توافر إقليم دائم وافراد يقيمون بصورة ثابتة عليه كي تنشأ الدولة ، بل لابد من ايجاد سلطة تؤلف العنصر الضروري لقيامها . وتزداد اهمية هذا العنصر بالنسبة للمجتمع الدولي ، فنحن لا نستطيع ان نتحدث عن السيادة الا مع نشأة السلطة السياسية واهميتها بالنسبة لإدارة الدولة من جهة ، والاعتراف الدولي من جهة اخرى .
