ظهر التدخل الدولي الإنساني في ظل الإهتمام العالمي وإزدياد عدد الإتفاقيات الدولية المتعلقة بحقوق الإنسان، على إعتباره وسيلة لحماية هذه الحقوق والدفاع عنها من الإنتهاكات، وأن الأساس القانوني الذي يبرر به التدخل الإنساني يستند إلى نص المادة (1) الفقرة (3) من أهداف الأمم المتحدة، والتي تنص على أن من مقاصد الأمم المتحدة وأهدافها تحقيق التعاون الدولي على حل المسائل الدولية ذات الصبغة الإقتصادية، والإجتماعية، والثقافية، والإنسانية، وعلى تعزيز إحترام حقوق الإنسان، والحريات الأساسية للناس جميعاً، والتشجيع على ذلك إطلاقاً بلا تمييز بسبب الجنس، أو اللغة، أو الدين، ولا تفريق بين الرجال والنساء، لكن مع بداية القرن الحادي والعشرين استخدم مبدأ التدخل الدولي الإنساني لتحقيق الأهداف الجيوإسترايجية للدول الكبرى.
