هذا البحث يجمع القواعد التي تساعد المجتهد في تقييد المباح مع ترتيب هذه القواعد واعتبار ما يناسب أن يكون قاعدة كلية عامة، وما يمكن أن يندرج تحتها أو يكون تابعا لها، وما يرد منها إلى أصل من أصول الشريعة أو إلى قاعدة أعم، يشير البحث إلى ذلك مع بيان معنى كل قاعدة وأدلتها، وذكر التطبيقات التي ذكرها الفقهاء والفروع التي تخرجت عليها، وما يستفاد منها في القضايا المعاصرة، وحلول المشكلات، متبعا المنهج الاستقرائي التطبيقي من خلال ثلاثة مباحث أولها اعتبار الحال في تقييد المباح، وثانيها اعتبار الانتقال، وثالثها اعتبار المآل ، ولا نقصد القيود التي ترد عند الأصوليين على سياق الخطاب الموجه إلى المكلفين، أو على البناء اللفظي للخطاب، فترى القيود التي يقصدونها قيودا لفظية كالشرط والعدد والصفة ونحو ذلك، وترد على المطلق فتقلل انتشاره أو تقيد بعض صفاته. ولكن مقصودنا هو القيد الفقهي، فالذي نبحث عنه في تقييد المباح هو ما ينصرف إلى التصرفات التي تصدر من المكلف والتي يبنى فوق حكمها الشرعي الأصلي وهو الإباحة وصفا جديدا زائدا وهو وجوب الالتزام به عند تناول المباح أو الأخذ به. ومرادنا هو القيود التي تقيد فعل المكلف المباح إذا تعدى به على حقوق الغير أو أوقع بإتيانه الضرر على نفسه أو على غيره، أو إذا انتقل إلى المحرم أو آل إليه أو كان ذريعة إليه أو انتفت السلامة بالأخذ به
