إنه بعد مضي نصف قرن على التخبط الفقهي الذي عمَّ وطمّ في أوساط عديدة، والذي لم ننل منه سوى التهرب من التطبيق لأحكام الشريعة، وإباحة المحرمات، والتشكيك في الدين، وتجهيل الدارسين وغيره مما يطول ذكره، فإنه قد آن الأوان أن يعود الفقه إلى ما كان عليه من الأصالة والقوّة التي عهدناها به حين حكمت به الدول الإسلامية المتعاقبة، وتخرج من كنفه العلماء العاملون، وأنشأ الطلبة المجدين المثابرين، وحافظ على دين العوام من الزيغ والهوان، وأجاب لهم عن كل ما يقع معهم.
فالواجب علينا الإنتقال بالفقه من التثقيف إلى العمل والتطبيق، إذ تدريسه بطريقة عرض آراء الفقهاء العظام في أمهات المسائل الفقهية في كل باب مع أدلتهم وترجيح الأقوى دليلاً، وهو تثقيف للطالب المبتدئ المحتاج إلى أن يضبط الأبواب بفروعها ودقائقها على مذهب فقهي معتمد؛ لتتكون لديه الملكة الفقهية، ويتمكن من التطبيق لما درس، وإفادة غيره منه.
