منذ وصول الابا شنودة الثالث الى مقعد بطريرك الاقباط الأرثوذكس بدأت مشكلة فصم عرى الزوجية فى شريعة الاقباط وذلك بعد صدور القرار البابوى رقم 7 لسنة 1971 للمجلس الإكليريكى برفض التصريح بالزواج الثانى لمن يحصل على حكم قضائى بالطلاق سوى لعلة الزان وذلك تأسيسا على تعاليم الانجيل ولا شك أن القرار يمثل امتدادا لتفسير قداسية الوارد فى كتابه الذائع " الزوجة الواحدة فى شريعة الاقباط الارثوذكس " ومنذ صدور القرار البابوى تزايدت الاحكام " القضائية " الصادرة بالطلاق للمرة الثانية . إن الفجوة بين تعاليم قداسة البابا وبين مشكلات الواقع الاجتماعى تطرح أسئلة عديدة حول واقع الأسرة القبطية المتغير وفروزة البحث عن حلول لمشكلاتها ولا سيما وأن لائحة 1938 وأراء فقه الأحوال الشخصية للمصرين غير المسلمين ومواقف أربعة بطاكة كانت تعتمد تفسيرا مغايرا يسوغ الطلاق بالزواج الثانى لاسباب عديدة غير علة الزنا .
