"إن المحافظة على النفوس من التلف يعد ضرورياً من ضروريات الدين المتفق عليها, وصيانة لهذا الأصل الشرعي فقد رتبت الشريعة القصاص على القاتل جزاءً وعدلا وتوعدته بالعقوبة الأخروية الشديدة، ومع ذلك فقد أسقطت الشريعة في صور حكم القصاص لتأول وقع فيه القاتل، وهنا يثور سؤال في غاية الأهمية: كيف يمكن المحافظة على الأصل الشرعي الأول ( حرمة الدماء ) من تمدد الحالة الاستثنائية (التأول)؟ وهو السؤال الذي يسعى ، هذا البحث العلمي الجاد في تقديم جوابه.
