ينقسم الكتاب إلى ثلاثة أبواب: ـ الباب الأول أثر الواقع في تطور حرية التعاقد وركز فيه الكاتب على تحرير مصطلحات البحث ومعاني مفرداته وأثر الواقع في تطور تلك المعاني، وتناول أيضا كيف حرر الفقه الاسلامي انطلاق من الكتاب والسنة حرية التعاقد وضبطها بالتعادل بين الغنم والغرم. ـ أما الباب الثاني فعنوانه: (أثر الواقع في تطور أنواع عقود الأصول الشرعية العامة الحاكمة على العقود المالية) وهو يهتم بجمع الاصول الشرعية العامة الحاكمة على العقود الملية في تطورها كنظرية شاملة في هذا البحث، في صلتها بالواقع. ـ في حين عنون الباب الثالث أثر الواقع في تطور صيغ التعاقد بدأ فيه بعقد البع باعتباره بوابة المعاملات المالية المستحدثة التي تحتاج إلى دراسة، خاصة الايجاز المنتهي بالتمليك.
