تسعى هذه الدراسة على التأكيد على حقيقة مفادها أن هناك أساساً قانونياً واسعاً لجرائم الرقابة على النقد في لبنان، سواء من خلال النصوص الجزائية في قانون العقوبات، أو من خلال بعض النصوص الجزائية الواردة في قانون النقد والتسليف، وأن هذه الجرائم يمكن حصرها بجريمة المضاربة غير المشروعة على النقد، وجريمة مخالفة قرارات السلطة النقدية، وجريمة الإمتناع عن قبول الليرة اللبنانية، وجريمة تضليل الرقابة التي يمارسها المصرف المركزي.
هذه الجرائم طرحت تساؤلات متعددة حول مدى توافقها مع القواعد العامة في قوانين العقوبات، وتحديداً مبدأ شرعية الجرائم والعقوبات، حيث ثبت – كما تبين هذه الدراسة – أن تشريعات الصرف لم تلتزم بمقتضيات هذا المبدأ، فهي قد تفوض سلطة ثانوية في التجريم، وبذلك يكون للإدارة سلطة واسعة تخرجها من نطاق التطبيق إلى مجال التشريع.
وبالإستناد إلى نص المادة 710 من قانون العقوبات، يطرح المؤلف مسألة شرعية هذه الجريمة، تماماً كما طرحت في فرنسا ومصر وسورية، عند الملاحقة الجزائية عن مخالفة أحكام قانون الرقابة لعام 1966 في الأولى (فرنسا) ، ولعام 1994 في الثانية (مصر) ، ولعام 1952 في الثالثة (سورية). إلى هذا توضح الدراسة القاسم المشترك بين القانون اللبناني وباقي قوانين الرقابة على النقد مثل العقوبات والتدابير الإحترازية ... وغيرها.
