يتناول هذا الكتاب اتجاهين في التشريعات المعاصرة لتحديد مايعد جريمة تهريب يقصر الاتجاه الأول التهريب على الأفعال التي يتم التخلص دون حق من الرسوم الجمركية المستحقة والاتجاه الثاني لم يقف بالتهريب عند هذا الحد بل يقصد إدخال البضائع الى البلاد أو إخراجها منها بطريقة تخالف قوانين الاستيراد والتصدير وتنقسم المخالفات الجمركية الى مخالفتان شكلية وموضوعية فالتهريب الحقيقي ويتحقق هذا النوع بادخال بضاعة تتحقق عليها الرسوم والجمركية والضريبه يحظر القانون استيرادها أو تصديرها والتهريب الجمركي ويقصد به نوع من التهريب تتخلف عن بعض العناصر الجوهرية التي يتكون منها التهريب الجمركي وينتقل الكتاب الى أركان جرائم التهريب فيذكر الركن الشرعي والركن المعنوي والركن المادي وفي الباب الثالث يشير الكتاب الى مسؤولية الجنائية من جريمة التهريب الجمركي ولكي تسند التهمة الى شخص ما لابد أن يكون الشخص مسؤولاً جزائيا يتمتع بادراك سليم وحرالإرادة ويكون مذنبا وإراداته آثمة ويتعرض الكتاب الى مسؤولية حائزي البضاعة المهربة هي جريمة يعاقب عليها القانون كما تقع المسؤولية على قادة الطائرات وربابنة السفن كناقلين للبضائع المهربة ويتناول في الباب الرابع عقوبات جريمة التهريب حيث تكون شرعية أو قانونية تطبيقا لاجريمة ولاعقوبة إلا بقانون وتكون العقوبة واحدة للجميع عند تشابه ظروف الجريمة وتكون العقوبة شخصية فقط لشخص ممرتكب الجريمة وتكون تعبيراً عن مقابل الجريمة معينة ومسؤولية عن هذه الجريم هذا بالإضافة الى عقوبة الحبس والفراق ومصادر المادة المهربة.
