عانى لبنان كثيراً من نتائج إغتيال الرئيس رفيق الحريري، فهو كان رئيساً سابقاً لحكومته، ولعدة مرات، ورئيساً لكتلة نيابية لها وزنها في الحياة البرلمانية.
فكان من الطبيعي أن يُحدث التفجير الذي حصل في 14 شباط 2005 أزمة سياسية داخلية توجت بسقوط الحكومة التي كانت قائمة حينها، فأعلن رئيسها الأستاذ عمر كرامي، إستقالتها.
كما كان من الطبيعي أن يكون هناك مساراً قضائياً يتابع خيوط الجريمة، وكان هناك إستعجالاً لكشف الحقيقة لدى عائلة الرئيس الحريري ومناصريه، وإلى جانب ذلك فقد تعددت الإتهامات السياسية التي استبقت التحقيقات العدلية، وصولاً إلى المطالبة بتحقيقات دولية لم يشهد لبنان مثيلاً لها، رغم غزارة الجرائم السياسية التي عرفها.
وبقدر ما كانت هناك إدانة محلية سياسية وشعبية لجريمة إغتيال الرئيس الحريري، فقد توسع الإهتمام الدولي بها، وصولاً إلى تشكيل مجلس الأمن الدولي لجنة لتقصي الحقائق، أصدرت تقريراً دانت فيه الأجهزة الرسمية اللبنانية والسورية، وحملتها المسؤولية شبه المباشرة عن الجريمة، بعد تحقيقات موجزة وغير معمقة، ففتحت الباب واسعاً أمام تدويل الجريمة وأمام تشكيل لجنة تحقيق دولية.
ولأن من المفيد للجمهورين السياسي والقانون في لبنان، أن يكون بين أيديهم دراسة حيادية حول الواقع القانوني لقضية إغتيال الرئيس رفيق الحريري، تنطلق من الحرص على الوصول إلى العدالة القضائية، وتحمل نقداً لأخطاء إجرائية وموضوعية جسيمة من المفيد تجنبها مستقبلاً، كما وترتكز على عامل المقارنة وهذا ما تستحقه هذه القضية التي أريد للكثيرين أن يكون لها وجهاً دولياً.
ولقد استغرق المؤلف العمل في هذا الكتاب أكثر من خمس سنوات، تضمن متابعة وتوثيقاً وتحليلاً للكثير من الأمور الإشكالية والدقيقة حول ملف التحقيق بمراحله كافة، وترافق مع نشره العديد من المقالات ذات الصلة، في صحف ومجلات لبنانية وعربية ودولية، ألحقت بهذا الكتاب، لكونها تركّز التسلسل الزمني لأبرز المحطات المفصلية التي استوجب بحثها في حينه.
وإنطلاقاً من هذا العمل الفقهي القانوني البحث، فقد تمحورت هذه الدراسة حول قسمين، الأول عن المرحلة السابقة للقرار الإتهامي، والثاني عن المرحلة اللاحقة لهذا القرار، ومن المتوقع أن تتبع هذا العمل أجزاء أخرى لتواكب فصول الملاحقة كافة.
