يعالج هذا الكتاب موضوع اختصاص النيابة العامة لدى القضاء الشرعي في الوطن العربي، صحيح أن القضاء في أغلب الدول العربية، قضاء وطني موحد، إلا أن القضاء الشرعي بقي محتفظاً بخصائصه التي تميزه عن الأقسام القضائية الأخرى لجهة قواعد الأحكام الشرعية للأحوال الشخصية التي يصدر أحكامه إنفاذاً لها، وأيضاً فيما يتعلق ببعض قواعد إجراءات المحاكمة، لاعتبار الإجراءات الأخرى مشتركة بينه وبين القضاء العادي.
ونظراً لتماثل دور النيابة العامة لدى القضاء الشرعي، في الدول العربية، حيث أن مصدر تشريعات هذه الدول، واحد هو التشريعات الغربية وبخاصة الفرنسية، أمكن القول، أن تعريف النيابة العامة ووظائفها وهيكليتها، تكاد أن تكون واحدة، باستثناء فروقات جزئية لا تتجاوز الأسس الرئيسة التي ترتكز إليها. من هنا يعالج هذا الكتاب، اختصاص النيابة العامة لدى القضاء الشرعي في لبنان كنموذج، مع مقارنات واسعة لاختصاصها لدى العديد من الدول العربية.
حيث يتناول الباب الفصل الأول مفهوم الادعاء العام في القانون الوضعي واللبناني، وأنظمة الاتهام وتعريف النيابة العامة، ومفهوم الادعاء العام في الشريعة الإسلامية، والمقارنة بينهما، وفي الفصل الثاني تاريخ استحداث منصب النائب العام الشرعي وأصول تعيينه والرقابة على أعماله وعلاقاته مع محيطه الوظائفي والعام، وانهينا الباب الأول بالحديث عن عضويته في مجلس القضاء الشرعي الأعلى.
ويدرس اختصاصات النائب العام لدى المحكمة الشرعية ويعقد المقارنة بينها وبين اختصاصاته لدى المحاكم الروحية في لبنان وبعض الدول العربية، في فصلين: الفصل الأول اختصاصات محامي الوثائق لدى المحاكم الروحية، والنيابة العامة لدى المحاكم الشرعية في بعض الدول العربية، والمحكمة الشرعية العليا في لبنان. الفصل الثاني: اختصاصات أخرى للنائب العام، وآثارها القانونية.
