قد آثرنا في بحثنا هذا أن نلم بأطراف موضوع النيابة ونحيط بجوانبه، فقد يكون في هذا الإلمام وهذه الإحاطة بعض الفائدة، إذ كلما اتسعت دائرة البحث زادت كمية المعارف وتعددت مجالات المقارنة واتضحت جوانب الموضوع.
وتوخيًا لتحديد المعاني وتوضيح الألفاظ بحسب استعمالها في كتب الفقهاء لم نرد أن ندع الباحث في تيه أو ننقله من تيه إلى تيه بالتفريق بين لفظي الوكالة والنيابة اشتغالًا بالصبغة الفقهية، فإن الوكالة والنيابة يدلان على معنى واحد في مفهوم الفقهاء.
وقد قسمنا هذا البحث قسمين: الجزء الأول خاص بالنيابة في الفقه الإسلامي، راعينا فيه أن يكون شاملًا من حيث الموضوع لكل مسائل النيابة بقدر الإمكان، ومن حيث آراء الفقهاء على كل المذاهب المدونة سواء أكانت مذاهب السنة، أي الحنفية والمالكية والشافعية والحنابلة، أم المذاهب المخالفة لها في بعض الأصول، أي الظاهرية والشيعة الإمامية والشيعة الزيدية والاباضية.
أما الجزء الثاني فهو خاص بالقوانين الحديثة، وقد راعينا فيه أن يكون شاملًا كذلك من حيث تناول الموضوع في القوانين الغربية ثم تناوله بعد ذلك في القوانين العربية.
وقد اخترنا من القوانين الغربية أشهرها الذي يدل على سائرها، كما كان هذا منهجنا بالنسبة للقوانين العربية، فإننا إذا عالجنا كل قانون سواء أكان ذلك بالنسبة للقوانين الغربية أم بالنسبة للقوانين العربية لاقتضى منا ذلك ألا نقتصر على هذا القدر من البحث بل يجب أن يطول النفس إلى تأليف موسوعة شاملة، ومنهج الموسوعات يختلف عن منهج البحوث في الخطة والأسلوب.
ونأمل أن نكون قد قدمنا شيئًا يضاف إلى ما بذل من جهود قيمة في هذا السبيل.
