كل نظام يشتمل على تفريعات جزئية، تنبثق عن أصول وكليات عامة، وتشكل الفروع والأصول منظومة متكاملة، تحكمها المقاصد العامة التي تقف وراء الأصول وتشكل المنظومة الفكرية التي تحدد إتجاه حركة التقنين والتفريع، والتي يمكن أن نعبر عنها بروح التشريع وجوهره وحكمته.
وإن مسائل التقنين الجزئية ينبغي أن تفهم في إطار تلك المنظومة، أي روح التشريع ومقاصده، ومتى ما اصطدمت بعض تلك الفروع، مع أحد المقاصد العامة، فإن هذا يعني وجود خلل ما في حركة الإستنباط والتقنين؛ وبالرغم من أن الأحكام الشرعية مستنبطة عن الأصول والقواعد والمباني الفقهية المقررة عند الفقهاء - حسب مدارسهم وإتجاهاتهم في عملية الإستنباط - إلا أن بعض تلك الأحكام لا ينسجم مع الإطار العام للشريعة الإسلامية، ولا يتفق مع مقاصدها الغرّاء، وذلك لغياب التأسيس العلمي للروح العامة التي ينبغي أن تكون مهيمنة على حركة الإستنباط.
وتأتي غاية هذه البحوث هو: إرجاع الأحكام الفقهية التي استنبطها الفقهاء إلى تلك المنظومة العامة للتشريع، وتلك الأحكام على أسس المنهجية الإسلامية، التي تقوم بمعالجة المسائل المختلفة في الحياة بموضوعية من خلال تفاعلها مع حركة الواقع، ودراسة مختلف أبعاده، مقروناً بآراء الفقهاء المختلفة في الموضوع، وهذه البحوث المسألة التي عنونها الفقهاء تحت اسم (حفظ كتاب الضلال).
وهذا الموضوع - ليس موضوعاً فقهياً بحتاً، وإنما هو مفردة رئيسية من مفردات فكرية وحضارية يتناولها الفقه الإسلامي بالدراسة والتحليل.
