كثيراً ما يجيب رجل القانون عن السؤال القائل: متي يسأل الشخص جنائياً؟ ولكنه لا يهتم الا قليلا بالاجابة عن السؤال القائل: لماذا يسأل الشخص جنائيا؟ عل يالرغم من انه سؤال اولي واساسي, وبغير الاجاب عن هذا السؤال الهام تظل الكثرةمن الابحاث القانونية وخاصة في المجال الجنائي تسير في طريق مسدود لا تخرج منه الا بتبينها عدداً من الحلول العملية الوقتية, وقد تصور الاتحاد الدولي لقانون العقوبات.
انه خرج من المأزق عندما اعتنق مبدأ الحياد في الصراع الفلسفي الدائر بين المدرسة التقليدية, وبين الاتجاهات الوضعية, حول الحتم والحرية في ميدان المسئولية الاجتماعية والحق ان بيان الاتحاد والمؤتمرات الدولية التي عقدت من خلاله تؤكد انحيازه الي الاتجاهات الوضعية في القانون الجنائي علي الرغم من حياده المعلن, وموقف الاتحاد الدولي لقانون العقوبات في حد ذاته يكشف مدى اهمية البحث في الاساس الفلسفي للمسئولية الجنائية.
حقا ان الموضوع شائك كما ان دراسته العلمية يعترضها الكثير من العقبات العلمية, ولكن مستقبل القانون الجنائي مرهون في الحقيقة بالنتائج التي يمكن الوصول إليها في مجال اساس المسئولية, انه البحث الوحيد الذي نستطيع من خلاله ان نتعرف علي ذاتيه القاعدة الجنائية وعلي سماتها وملامحها, كما انه الشخصكفيل بالوصول الي حلول معقولة في قضايا معلقة كثيرة مثل مسئولية الشخص المعنوي جنائيا واثر الجنون والحالات العقلية الاخري والسكر وغير ذلك علي المسئولية الجنائية, ويمكن الوصول ايضا الي تعليل معقول لحالات الاعفاء من العقاب الجنائي بأسبابها المختلفة, ومن هنا تنبع اهمية هذه الدراسة المقارنة التي اقامها الباحث في ثلاثة فصول هي: جرائم امن الدولة الخارجي , جرائم امن الدولة الداخلي, والتجمهر والشغب.
