إنّ دراسة مخاصمة القضاة دراسة مقارنة تطلبت منا الوقوف عند ماهية دعوى المخاصمة من خلال التعرف على التطور التاريخي لمخاصمة القضاة، وكذلك تعريف دعوى المخاصمة، وتمييز مخاصمة القضاة عن النظم المشابهة لها، إضافة إلى الطبيعة القانونية لدعوى مخاصمة القضاة مدنياً.
ومن ثم التطرق إلى نطاق دعوى مخاصمة القضاة مدنياً سواء من ناحية النطاق الشخصي أو الموضوعي، مع التوقف عند نطاق الإثبات في دعوى المخاصمة. وبعد ذلك كان الحديث عن دعوى المخاصمة والفصل فيها في عدة دول عربية وأجنبية، وذلك من خلال بيان إجراءات رفع دعوى المخاصمة وشروط قبولها ونظر دعواها، وكذلك الحكم في موضوعها. وصولاً إلى خاتمة تحوي مجموعة من النتائج والتوصيات في هذا المضمار، ولتعميم الفائدة كان لابد لنا من تضمين هذا الكتاب ملحقاً خاصاً بمشروع قانون مخاصمة القضاة مدنياً.
