في هذا الكتاب يقدم القاضي المتدرج محمد مرعي صعب دراسة مقارنة تحليلية تفصيلية لما هي عليه حال القضاء في لبنان وتصور واعد لما يرجى أن تكون عليه، فضلا عن شروط الدعوى ضد القاضي وإجراءاتها وأثارها.
عن دراسته هذه يقول المؤلف "لقد طرحنا الكثير من الأسئلة حول هذه الدعوى، وسنحاول الإجابة عليها من خلال هذه الدراسة التي تعالج هذا الموضوع بشقيه، القانوني البحت، وهو المتعلق بشروط الدعوى ونطاقها.. والشق الآخر الشخصي الإجتماعي، وهو المتعلق بشخص القاضي ومواصفاته ومسؤوليته وواجباته التي لا يتكلم عنها الكثيرون والتي نرى ضرورة التركيز عليها...".
وبناءً على ما تقدم تتناول الدراسة: طبيعة المواصفات الواجب توفرها في القاضي، مهمة القاضي ومتطلباته وواجباته، الشروط الإجتماعية اللازمة ليقوم القاضي بمهمته، الأسباب التي من شأنها أن تجعل القاضي ينحرف عن مهمته، النصوص القانونية التي تحكم دعوى المخاصمة في لبنان، إجراءات دعوى المخاصمة والفصل فيها من حيث رفع الدعوى وشروط قبولها، ونظر الهيئة العامة بالدعوى ومفاعيلها، إلى آخر ذلك من الآثار المترتبة على الحكم موضوع المخاصمة.
