تُعد إشكالية الجرائم الإرهابية واحدة من القضايا الأكثر رواجاً وتعقيداً في السنوات الأخيرة، ولكأنما يهدينا الإرهاب في كل يوم كارثة تهدد الأمن والسلام، فهذا النوع من القضايا؛ الذي اختلطت فيه الأوراق، وتداخلت فيه المصالح، حتى بات الإنسان فيه، من خوفه أو من فرط خوفه، لا يُفرق بين الخصم والمنافس والعدو، في خضم التزاحم والتدافع المنطقي وغير المنطقي، على مَوَاطِنِ القوة والنفوذ والسطوة والشرهة، وبين الصراعات القائمة على مبدأ إختراق الفكر، وإحتلال الرأي، ونفي الوجود.
إذ بات من السهل توجيه كل الغرائز والعواطف الدينية والعرقية والمذهبية والطائفية نحو الوجهة الخاطئة، وهو ما دفعنا للبحث في موضوع الإرهاب، فهو العنوان الذي طالما تسبب في نزيف الدم العربي، وبات حاضراً وبقوة في كلب نقاش جاد حول مصير هذه الأمة ومستقبلها.
وحيث إن الإرهاب له العديد والعديد من الصور والأشكال، وقد اختلفت معظم التشريعات العقابية العربية والمقارنة في منظور معالجتها لهذا الموضوع، فإن الأمر يحتاج إلى بحث دقيق لتحديد ماهية الإرهاب، ومدلوله اللغوي، والجرائم التي تعدُّ إرهاباً ويمكن أن نطلق عليها جرائم إرهابية، وموقف المشرع العقابي من تلك الجرائم، وما للتشريع الجنائي الإسلامي من دورٍ بارز في تقويم تلك المعالجات وتصحيحها.
