مجلة "القرارات الكبرى في الاجتهاد اللبناني والمقارن" تعني بنشر أهم الأحكام والقرارات الصادرة عن القضاء اللبناني والأجنبي بغية إيصالها إلى القارئ كل شهر. فهي إذاً مجلة شهرية. وإذا كانت التسمية تدل على عناية المجلة بالأحكام والقرارات، فمما لا شك فيه أنه قد اهتم بتخصيص ركن منها للتشريع، وآخر للدراسات القانونية، كلما دعت الحاجة وتيسر ذلك.
هذا ولم تقصر المجلة على قرارات محكمة التمييز وحدها، بل جمعت الأحكام والقرارات، سواء كانت صادرة عن قسم أو غرفة بدائية أو استئنافية أو مجلس شورى أو مجلس عمل تحكيمي أو محكمين.
المهم أن يكون الحكم أو القرار نموذجياً، يتضمن من المبادئ ما يشبع نهم القارئ ويعطيه الجديد والمستحدث من أفواه القضاة الناطقين بالقانون. ومن البديهي القول أن الأحكام والقرارات سوف تطال كافة الميادين من مدنية وتجارية وجزائية وتحكيمية وإدارية.
وبين يدينا العدد الثاني والثلاثون من هذه المجلة وهو خاص في قضايا الاستملاك، حيث يعرض لجملة من القرارات الصادرة عن المحاكم اللبنانية المتعلقة بـ: استملاك –شروط طلب إعادة النظر بقيمة التعويضات المحكوم بها، استملاك –عدم صدور قرار مبرم يجيز إعادة النظر في التعويض –الربع المجاني لا يطبق إلا في الاستملاك التخطيطي، استملاك –إعادة تخمين التعويض –كيفية حسابه في حال قبض المستملك ضده جزءاً منه، استملاك –استئناف الحكم دون دفع الرسم –جواز تصحيح العيب، استملاك –حق اللجنة في النظر في الاستملاك الكامل، استملاك –مدى صلاحية اللجنة- حساب الربع المجاني على الوحدة العقارية الظاهرة من الطابو، استملاك –لا يجوز للجنة الاستئنافية تعديل التخطيط، استملاك –عدول الإدارة عن المشروع- المهلة القانونية- اختصاص القضاء العدلي، استملاك –عناصر تقييم التعويض- جواز إعادة النظر فيه، استملاك –كيفية تقدير التعويض ومدى تعديله استئنافاً. رسوم المحاكمة على عاتق من عجلها، استملاك –تحديد التعويض في ظل القانون السابق- إعادة النظر به- إبقاء النفقات على عاتق من عجلها، تشريع –قانون الاستملاك رقم 58/91 الصادر في 29 أيار 1991.
