تتسم الكثير من القرارات الصادرة عن المحاكم المختلفة بكونها نهائية، ولكن القانون ينص على آلية لاستعادة هذه القرارات، وهذا الأمر من مبتكرات الاجتهاد وهي عملية تنظمها ضوابط اجتهادية، وما تسعى إليه مجلة "القرارات الكبرى" في الاجتهاد اللبناني والمقارن هو الاعتناء بنشر أهم هذه الأحكام والقرارات الصادر عن قسم أو غرفة بدائية أو استئنافية أو مجلس شورى أو مجلس عمل تحكيمي أو محكمين.
المهم أن يكون الحكم أو القرار نموذجياً، يتضمن من المبادئ ما يشبع نهم القارئ ويعطيه الجديد والمستحدث من أفواه القضاة الناطقين بالقانون. ومن البديهي القول أن الأحكام والقرارات سوف تطال كافة الميادين من مدنية وتجارية وجزائية وتحكيمية وإدارية.
وبين يدينا العدد التاسع والخمسون من هذه المجلة وهو يبحث في الشركة الفعلية في لبنان -دراسة مقارنة، حيث بحث في شروط تطبيق الشركة الفعلية، وآثار تطبيقها.
أما القسم الثاني من الكتاب فهو يعرض لجملة من القراءات الصادرة عن المحاكم اللبنانية والمتعلقة بـ: اختصاص جزائي -لبناني متهم بالتجسس على الأراضي اللبنانية لصالح إسرائيل -لا صلاحية للمحاكم السورية لمحاكمته، استرداد للضرورة العائلية -إضافة طلب جديد في الاستئناف لأول مرة مبني على التملك -جوازه، اعتماد مستندي قابل للتحويل -تحويله يشكل عملية فتح اعتماد جديد -علاقة وكالة بين أطرافه، إفلاس احتيالي -إخفاء المفلس لدفاتره -تبديد أموال الزبائن والتلاعب بها بنية الغش، تبليغ استثنائي -شروطه -غاياته- مخالفته للأصولـ تبليغ استثنائي -وجوب التحقق من مجهولية الإقامة قبل اللجوء إليه، تزوير مستند -أصول تقديمه- تفويض خاص- عيب مبطل- تصحيحه خلال المهلة، خصومة مؤلفة بشكل غير أصولي -عدم جواز تصحيحها استئنافاً -رد الدعوى، قرار تحكيمي -الطعن به من خلال صورة فوتوكوبي.
