تنطلق هذه الدراسة من فرضية رئيسية هي: أن بنية دولة الإسلام الأولى دولة الرسول صلى الله عليه وسلم، ودولة الخلفاء الراشدين رضي الله عنهم تضمنت ما هو تشريعي، وما هو تاريخي، والتشريعي ملزم للمسلمين في كل زمان ومكان، والتاريخي جاء استجابة لظرف، ومرحلة ولا يجوز أن ينظر إليه خارج هذا الإطار، وحاولت الدراسة على مدى، أبوابها، وفصولها، ومباحثها أن تمحص هذه الفرضية من خلال الاستعراض التاريخي والفقهي لقضايا بناء الدولة ومراحلها.
وهكذا جاء هذا البحث على محورين رئيسيين: المحور الأول: الدولة التي أنشأها رسول الله صلى الله عليه وسلم في المدينة المنورة بعد أ، هاجر إليها، وخصائص هذه الدولة، والدولة التي يتم التحدث عنها هي الدولة بالمعنى الشامل: السلطة بأشكالها المختلفة، والأرض، والشعب، والقانون الذي يجمع بين هذه العناصر كلها. المحور الثاني: الدولة في فترة الخلافة الراشدة الممتدة من عام (11هـ-41هـ).
