تشكل نظرية الدعوة الجسر الذي يربط القضاء الشرعي بالقضاء المدني، وهي تخضع لقواعد كثيرة، كما أنها تعتبر سمة من سمات قانون القضاء المدني والشرعي. والدعوى هي الباب الرئيسي لتحري العدل بواسطة القضاء وهي الوسيلة الأساسية لتحصيل الحقوق المتنازع عليها.
وفي هذا الكتاب يسلط المؤلف الضوء على المبادئ والأصول التي ترتكز عليها الدعوى، وهو يهدف من وراء دراسته هذه إلى تعميق الفهم بالدعوى الشرعية في الإطار القانوني الموضوع لها، ويلجأ إلى إجراء المقارنة بين نظرية الدعوى الشرعية في إطارها القانوني وبين نظرية الدعوى في إطارها الشرعي الإسلامي. مظهراً من خلال ذلك أهمية التشريع والفقه الإسلامي في هذا الموضوع.
وقد اعتمد في دراسته منهجيته بحث قوامها أربع ركائز، فهو يقدم لمحة تاريخية عن المحاكم الشرعية في لبنان والأطوار التي مرت بها، ويتطرق إلى الأساس القانوني للدعوى والشرعية، ثم يفصل الكلام عن الدعوى الشرعية وطبيعتها وأنواعها وأسبابها وأركانها وأطرافها وشروطها كما يعرض إلى إجراءات النظر بالدعوى الشرعية والمبادئ العامة للنظر بها وأصول المحاكمات المتبعة في الدعوى الشرعية وأخيراً يبين كيفية انتهاء الدعوى وطرق الطعن المعتمدة في الحكم الشرعي.
