من الثابت أن حقوق الإنسان تولد مع الإنسان نفسه، وإستقلالاً عن الدول بل وقبل نشأتها، لذلك تتميّز هذه الحقوق بأنها واحدة في أي مكان من المعمورة، فهي ليست وليدة نظام قانوني معيّن إنما هي تتميّز بوحدتها وتشابهها، بإعتبارها ذات الحقوق التي يجب الإعتراف بها وإحترامها وحمايتها، لأنها جوهر كرامة الإنسان التي لا يمكن التصرّف بها.
كما إن إحترام حقوق الإنسان وحرّياته الأساسية يجب أن يتمّ ليس فقط من الناحية القانونية، وإنما أيضاً من الناحية الواقعية والفعليّة، وقد أصبحت حقوق الإنسان حالياً موضع إهتمام القانون الدولي المعاصر، ورغبة في عالم جديد أفضل وأكثر تحقيقاً للعدالة الإجتماعية والكرامة الإنسانية.
من هنا جاءت أهمية دراسة القواعد القانونية لحقوق الإنسان والتي تضمنتها صفحة هذا الكتاب تقتضي منا تقسيمها، وقد قسمت الدراسة إلى ثلاثة أبواب وملاحق.
الباب التمهيدي: ويعتبر هذا الباب المدخل الضروري لفهم ما سيأتي في تفصيل حول حقوق الإنسان، الباب الأول خصص لدراسة مفهوم حقوق الإنسان في الإطار القانوني والشرعة الدولية المكوّنة لهذه الحقوق، الباب الثاني: وكرِّس للحديث عن كيفيّة تدرّج حقوق الإنسان إلى مراحل من حقوق سلبيّة إلى حقوق إيجابيّة ثم إلى حقوق جماعية.
أما الملاحق، فتتضمَّن الأنشطة الضرورية للإنتقال بهذه المادة الحقوقية من الجانب النظري إلى الجانب العمليّ، ثم ورد المؤلف النصوص الأصلية للإعلان العالمي لحقوق الإنسان، والعهدين الدوليين فالبروتوكول الإختياري للعهد الدولي الخاص بالحقوق المدنية والسياسية، وأخيراً وثيقة إنشاء مجلس حقوق الإنسان التابع للأمم المتحدة.
