تقوم خطة هذه الدراسة على المحاولة الجادة للوقوف على المسائل العديدة التي تثيرها جريمة الافتراء في التشريع الجزائي، بغية التعرف على مدى ملاءمة النصوص العقابية الخاصة بها لمواجهة هذا النوع من الجرائم وأيضاً بغية الكشف عن الجانب الشكلي لهذه الجريمة لمعرفة الإجراءات الواجب اتباعها للسير بالدعوى المتعلقة بها، وطرق إثباتها أو نفيها أمام القضاء.
لذلك، فقد تم تقسيم هذه الدراسة إلى قسمين، يسبقهما باب تمهيدي، حيث يتضمن الباب التمهيدي التعريف بجريمة الافتراء لغة وفقهاً وقانوناً مع بيان العلة في تجريم هذه الظاهرة، والتطوير التشريعي لها، وتميزها عن بعض الصور الإجرامية التي قد تشتبه بها. أما القسم الأول، فقد خصص لدراسة القواعد الموضوعية لجريمة الافتراء، من حيث بحث أركان هذه الجريمة وعناصرها والعقوبة المقررة لها.
أما القسم الثاني فقد خصص لدراسة القواعد الإجرائية لجريمة الافتراء من حيث كيفية تحريك الدعوى العامة المتعلقة بها، والجهات القضائية المختصة بنظرها وطرق إثباتها وضوابط الأحكام الصادرة بصددها.
هذا وقد حاول المؤلف كل ما في وسعه أن يوضح موقف قانوني العقوبات اللبنانية والأردني في شتى المواضيع والمسائل التي احتلت مكانها في هذه الدراسة، وبيان موقف الفقه والقضاء من هذه المسائل. إن إظهار رأيه الشخصي إن أمكن من هذه المواضيع والمسائل.
