يعالج الكتاب ثلاثة موضوعات أساسية، الأول- نظام الدولة وآدابه في الإسلام وهو أحد الجوانب المضيئة في حضارة وتراث الإسلام إذ يشتمل على مبادئ وسلوكيات تضاعي أحداث النظريات للدولة العصرية.
والموضوعان الآخران هما القضاء والعرف في الإسلام، واللذان يعتبران من أهم الموضوعات التي حوتهما كتب التاريخ والفقه الإسلامي، وقد اهتم بهما العلماء في كل العصور فكتبوا عنهما في مؤلفاتهم العامة والخاصة.
ولما كان نظام الدولة والقضاء والعرف في الإسلام أحد الأنظمة المعمولة بها في العالم، ويعتبر بذات الوقت أحد المصادر المهمة للدولة والقضاء والعرف في معظم الدول الإسلامية والعربية، فإن الكتاب يتجه إلى معالجة موضوعات مهمة مشتركة بين القانون الوضعي والشريعة الإسلامية، بحيث يوضع النظامان جنباً إلى جنب على صعيد الدراسة المقارنة، بغية معرفة خصائص كل منهما ومدى التقائهما أو تمايزهما في المبادئ والأفكار.
وبذلك يسهم هذا الكتاب في إبراز معالم الدولة والقضاء والعرف في الإسلام، مقارنة بالنظام الوضعي، رغبة في تشجيع الدراسات المقارنة مع الشريعة الإسلامية التي هي ليست مجرد دين وعبادات فحسب وإنما هي أيضاً معاملات ونظم ومبادئ.
