تنص التشريعات الجزائية على العديد من الضمانات للخصوم في الدعوى الجزائية منها الوجاهية والشفوية والعلانية ويتناول هذا المؤلف إحدى هذه الضمانات وأهمها وهي الضمانة العلانية التي تُعد من الموضوعات الإجرائية المهمة التي تستحق البحث، ومن إستقراء نصوص قانون أصول المحاكمات الجزائية في كثير من الدول نجد إن هذه الضمانة غير موجودة إلا في مرحلتي التحقيق الإبتدائي والمحاكمة، أما مرحلة التحري وجمع الأدلة فهي تتميز بالسرية التامة.
أما أهميتها فتكمن في نواحي متعددة منها تحقيق الرقابة على عمل السلطات التي تباشر التحقيق مما يبعدها عن التحيز والمحاباة، وهذا بدوره يضفي الإطمئنان في نفوس المخاطبين بأحكام القانون لا سيما الخصوم في الدعوى الجزائية.
ومشكلة البحث جوانبها متعددة، أولها وإذا كانت العلانية في التحقيق الإبتدائي في أغلب القوانين هي علانية نسبية، إلا إن الوضع لا يبقى كذلك حيث لا يمكن السيطرة على هذه السرية بالنسبة للجمهور وسرعان ما تنتشر المعلومات عن هذه الإجراءات، وإذا كانت العلانية في المحاكمة تتحقق عن طريق حضور الجمهور لإجراءات المحاكمة فإن المشكلة الثانية تكمن في مدى تحقق العلانية عن طريق هذا الحضور لا سيما وإن الحاضرين غالباً ما يكونون من المتبطلين وغير المثقفين.
وهناك مشكلة أخرى تتعلق بالنشر لإجراءات المحاكمة بكافة طرقه وتحديداً ما يتعلق بإستخدام الكاميرات داخل قاعة الجلسة لنقل هذه الإجراءات تكمن بالنقل غير الكامل، حيث إن هذا النشر قد لا يكون شاملاً لكل الإجراءات وإنما يقتصر على نشر بعض الإجراءات دون غيرها وهو ما يؤثر في العلانية.
والمشكلة الأخيرة تتعلق بحضور الجمهور إجراءات المحاكمة، وتتمثل في حالة ما إذا حضر الجمهور بعدد يزيد على سعة قاعة الجلسة - وهو ما يحدث في بعض القضايا المهمة - مما يؤدي إلى حصول إضطراب في القاعة وهذا بدوره يؤثر على القاضي في الوصول إلى الحكم الصحيح.
