يحتوي هذا الجزء وهو الخامس من سلسلة "صادر في التمييز" القرارات المدنية على القرارات المدنية الصادرة خلال سنة 2001: وأهم ما جاء في الغرفة الأولى في موضوع الارتياب بحياد المحكمة، هو أن لا سبب للارتياب بحياد قاضي التحقيق عند خطئه في تقرير المحكمة المختصة للنظر بالجرم أو عند خطئه في تقرير إصدار مذكرة الإحضار، كما قضي أيضاً بأن الارتياب بحياد أحد أعضاء المحكمة لا يشكل سبباً لنقل الدعوى.
وفي الموضوع العقاري، كان هناك تأكيد عدم صلاحية القاضي العقاري للنظر بالالتزامات العقيدة وإنما بإعمال التحديد والتحرير فقط.
أما الغرفة الثانية، وهي المختصة بالقضايا العقارية، فقضت بأن ملكية الممر تبقى لصاحب العقار المرتفق لا لصاحب العقار المرتفق به وشددت على التمييز بين شروط انحباس كل من العقار المعد للسكن والعقار المعد للاستثمار الزراعي أو الصناعي,
وفي قضايا مخالفات البناء، قضت هذه الغرفة بوجوب مراعاة حقوق الغير عند تسوية هذه المخالفات واعتبرت الضرر واقعاً لمجرد عدم مراعاة التراجع المفروض على البناء. وقد كانت لهذه الغرفة مواقف قيمة في أمور تتعلق بالوسط التجاري لمدينة بيروت.
وفي قضايا الإيجارات، قضي بأن عدم استهلاك الماء والكهرباء ي المأجور خلال فترة معينة قرينة على الترك...
إن كل ما ذكرناه لا يشكل إلا جزء يسير من وابل المبادئ أقرتها محكمة التمييز بمختلف غرفها والتي تم فهرستها بشكل مبسط.
