يهدف هذا البحث إلى بيان موقف كل من الفقه والقوانين الوطنية والإتفاقيات الدولية وقواعد التحكيم ذات الطبيعة الدولية من مسألة القانون الواجب التطبيق على إجراءات التحكيم التجاري الدولي.
ولقد تناول البحث التعريف به وبأهميته وبسبب إختياره، ثم انتقل إلى معالجة موقف الفقه الذي ذهب في إتجاهين الأول: يتمثل في إخضاع إجراءات التحكيم لقانون مقر التحكيم، والثاني: يتمثل في إخضاع إجراءات التحكيم لقانون الإرادة المستقلة.
ثم يتناول موقف بعض القوانين الوطنية التي صدرت مؤخراً بشأن التحكيم وعلى رأسها قانون التحكيم الأردني رقم (31) لسنة (2001)، وموقف بعض الإتفاقيات الدولية وقواعد التحكيم ذات الطبيعة الدولية، بهدف الوصول إلى تحديد القانون الواجب التطبيق على إجراءات التحكيم.
وانتهى البحث بخاتمة تتضمن بعض الإستنتاجات والتوصيات.
