يختلف هيكل السلطة الإدارية في العصر الحديث تماماً عما كان عليه العهد من قبل في القرن التاسع عشر، ففي خلال ذلك القرن كانت الحكومة تقصر نفسها وجهودها على الإهتمام بحفظ الأمن والدفاع والشؤون الخارجية تاركة شؤون الصناعة لأرباب المصانع وتجار الجملة والقطاعي وتاركة أعمال البر والتقوى للهيئات الخيرية، ذلك لأنها لم تكن تخطط لأي شيء، ولا لأي شخص.
فلسفة ذلك العصر بوجه عام هي: دعه يعمل، وهي في بريطانيا على وجه أخص فلسفة الفردية أو الليبرالية، أما في هذا القرن العشرين فإن الحكومة تهتم بأي وجه من أوجه النشاط في حياة الأفراد، واضحت دولتنا هي دولة للرفاهية والتخطيط.
وقد منحت المصالح الحكومية سلطات أكثر في شتى المناحي، وأنشأت ضروباً من المحاكم ولجان التحقيق، وهي تمارس سلطاتها التقديرية غير المحدودة، ونظمت المصالح الحكومية مسائل الإسكان والعمالة والتخطيط والضمان الإجتماعي وضروباً أخرى من النشاط لا حصر لها.
إن فلسفة هذا العصر هي الإشتراكية أو الجماعية ولكن أياً كانت الفلسفة المسيطرة في عصرنا فإن هناك خطراً يتهدد المواطن العادي، وهو خطر يكمن في أن أي سلطة عرضة لسوء الإستعمال أو الإنحراف.
ومن ثم فإن أعظم المشاكل التي تواجه المحاكم في هذا القرن العشرين يتمثل في أنه في عصر تزايدت فيه سطوة السلطة التنفيذية كيف يواجه القانون مسائل إنحراف السلطة أو سوء إستعمالها، ومثلما أضحى الملقاط أو الكوريك غير ملائم لجرف الفحم، كذلك لم يعد إجراء إستصدار أمر بعمل شيء معين Mandamus وإجراء الفحص أي الأمر لمحكمة دنيا بالكف عن نظر قضية ورفعها إلى محكمة أعلى لفحصها Certiorari وقضايا الحالة Actions On The Case أمراً ملائماً لصيانة الحرية في هذا العصر الحديث، ذلك أنه يتعين علينا في هذا العصر أن نعالج التغيرات ذات الدلالة الدستورية المماثلة لتلك الدلالات التي كانت قائمة منذ 300 عام تقريباً.
