Book Description
بدأت الدولة العثمانية بتطبيق الشريعة الإسلامية وأحكام الحقوق الإسلامية منذ تأسيسها، وإن أول الموظفين الذين عيّنتهم الدولة كانوا القضاة والمفتشين المكلفين بتطبيق الشريعة الإسلامية وقرارات القاضي.
وكانت كتب الفقه الإسلامي هي المرجع الوحيد للمحاكم الحقوقية (المحاكم الشرعية) في الدولة.
لذلك استمرت أصول دراسة كتب الفقه (متناً وشرحاً وحاشيةً)، واستخدم من كتاب "الغرز شرح الدرر" لملا خسرو، ت 885هـ، وهو من فقهاء عهد السلطان محمد الفاتح، كمرجع يد في المحاكم.
وجعل كتاب: "ملتقى الأبحر" للإمام إبراهيم الحلبي، وشرحه "مجمع الأنهر" للشيخ عبد الرحمن أفندي كمرجع حقوقي رسمي (أي: دستور) للدولة العثمانية، وصدر بشأن ذلك الفرمان السلطاني عام 1648م، والفرمان السلطاني عام 1687م.
إن أحكام الفقه الإسلامي منثورة في الكتب الفقهية في كل مذهب من المذاهب الإجتهادية، وهناك أحكام فقهية كثيرة موجودة في غير مكان بحثها، وهذه الكتب متفاوتة في إستيعابها للأحكام والآراء المذهبية فحسب كونها مختصرة أو مطولة، وبحسب إختلاف الروايات عند أهل المذهب، أو لإختلاف المخرجين لأحكام الحوادث الجديدة.
فالبحث عن نصوص الأحكام الفقهية في تلك الكتب وإستخراجها من مظانها وغير مظانها، ومعرفة القول الراجح من الضعيف المرجوح يحتاج إلى قدرة عقلية فقهية تصعب على الكثيرين.
لذلك اهتم الفقهاء العثمانيون بتدوين الكتب التي تضم الفتاوى، والتي تحتوي على حلول القضايا والمسائل الفقهية على شكل سؤال وجواب.
وكانت فتاوى شيخ الإسلام أبو السعود أفندي، وعبد الرحيم زادة أفندي من أهم مصادر التشريع الإسلامي في الدولة العثمانية، ولا زالت هذه الفتاوى تحتفظ بأهميتها ومكانتها إلى يومنا هذا.
