لقد تعددت الآراء الفقهية حول موضوع بطلان العقد وصورتيه.. وما إذا كان العقد باطلاً بطلاناً مطلقاً أو نسبياً.. حتى تكونت تحديدات حصرية للسؤال بحيث أفرد المشترع في صلب قواعد الأًول دعوى جديدة لها طبيعتها.. وأقسامها.. وشروط إثباتها.. والتنازعات الحاصلة بشأنها.. واحتمالات طرحها أو إثارتها.. وصورها المختلفة.. فكانت دعوى الصورية.. ومفاعيلها والقواعد القانونية التي فسرتها ونظمت أحكامها وطرق التقاضي بها.
إن القاضي في دعوى الصورية يلتزم في تفسير إرادة المتعاقدين -حقيقة هذه الإرادة وصوابيتها- وله سلطة التقدير في الكشف عنها بالاستناد إلى القرائن والوثائق وكامل أوراق ملف القضية.
القاضي يستخلص إرادة المتعاقدين من الواقع الذي ثبت عنده ويجب أن يكون هذا الواقع ثابتاً من مصادر موجودة فعلاً لا وهماً، غير مناقضة للثابت في الدعوى.
وتبقى العبرة، في تكييف العقود أي بحقيقة الواقع والنية المشتركة التي اتجهت إليها إرادة المتعاقدين دون الاعتداد بالألفاظ التي استخدماها أو بالتكييف الذي أسبغاه على العقد.
في هذا الإطار يأتي كتاب المحامي "نزيه نعيم شلال" الدعوى الصورية متناولاً وبكثير من التفصيل مبادئ هذه الدعوى ملقياً الضوء على بعض الأحكام القضائية الهامة التي تناولت هذه الدعوى متبعاً على نصوص المواد القديمة معتبراً أن الأهم هو الاجتهاد حول الصورية لا رقم المادة التي من الممكن أن تكون قد تعدلت أو أبدلت برقم آخر نظراً لتطور الاجتهاد، وتحديث القوانين. هذا وقد اعتمد أسلوب الدراسة المقارنة أو التوثيق المقارن للاجتهادات أو الآراء الفقهية المتقابلة أو المتشابهة أو المكملة للبحث.
