وقف الدعوى يعني عدم السير فيها فترة من الزمن. وهناك أسباب كثيرة تدعو القاضي المدني إلى وقف الدعوى المدنية، بعضها يكون وجوبياً بحكم القانون، والبعض الآخر يكون جوازياً متروكاً لتقدير المحكمة إذا ما رأت أن حسن سير العدالة يقتضي تعليق الحكم في الدعوى على الفصل في مسألة أخرى تخرج عن اختصاصها وتدخل في اختصاص محكمة أخرى، أما وقف الدعوى المدنية لحين الفصل في الدعوى الجنائية أو قاعدة "الجنائي يوقف المدني" فتحكمها قواعد خاصة بمقتضاها يظل القاضي المدني مكتوف اليدين لا يستطيع السير في نظر الدعوى المدنية- رغم اختصاصه بنظرها- إلا بعد الفصل نهائياً في الدعوى الجنائية، وعلى الرغم من الأهمية القصوى لهذه القاعدة، وكثرة المشاكل التي يثيرها تطبيقها في العمل، فإنها لم تلق العناية الكافية والدراسة التأصيلية الواجبة لها في مصر، فلم يتعرض لها شراح القانون إلا في عبارات وجيزة لا تناسب ما لها من أهمية، يستوي في ذلك شراح قانون الإجراءات الجنائية وشراح قانون المرافعات المدنية والتجارية.
ومن خلال مباشرتي للعديد من القضايا رأيت الحاجة ملحة إلى وضع مؤلف يعالج موضوعات هذه القاعدة، ويوضح ما يكتنفها من غموض، ويضع الحلول العملية للمشكلات التي يثيرها تطبيقها في العمل، وقد رأيت أن أقسم هذه المؤلف إلى ثلاثة أبواب: تكلمت في الباب الأول عن الأساس الذي تقوم عليه هذه القاعدة، وجعلت الباب الثاني في شروط تطبيقها، أما الباب الثالث فبينت فيه الآثار التي تترتب على تطبيقها.
