يشمل قانون الجزاء العماني رقم 7 لسنة 1974 – ككثير من القوانين – على نوعين من النصوص: فمن ناحية يحتوي على نصوص تتضمن الأحكام العامة للجرائم والجزاءات، وهي نصوص المواد من 1 إلى 119 ويحتويها الكتاب الأول بعنوان "في الأحكام العامة"، ويطلق عليها القسم العام من قانون الجزاء. وضم هذا القسم الأخير كافة القواعد التي تطبق على جميع الجرائم والجزاءات إلا ما استثناه المشرع منها بنصّ خاص، ويعني هذا القسم ببيان الأركان العامة للجريمة والأحكام التي تخضع لها، ووضع ضوابط عامة متفرقة بين المشروع وغير المشروع من الأفعال، بالإضافة إلى بيان القواعد العامة للجزاءات من عقوبات والتدابير. وفي عبارة موجزة يمكن القول أن هذا القسم يشمل على الأحكام التي تسري على كافة الجرائم بغض النظر عن أفرادها، وعلى المجرمين من حيث تحديد مسؤوليتهم وما قد يعتريها من مؤثرات، وعلى الجزاءات بوجه عام من حيث أنواعها والأحكام الخاصة بكل نوع.
ومن الناحية الثانية يحتوي على قدر من النصوص يحدد بها ما يعتبره القانون جرائم وما يقرره لها من عقوبات، ويعبر عنه بالقسم الخاص، ويحتويها الكتاب الثاني من قانون الجزاء العماني بعنوان "في الجرائم" في احدى عشر بابا متتاليا.
سنتناول في هذا الكتاب دراسة لأهم الجرائم المضرة بالمصلحة العامة في قسمين مستقلين، ندرس فيها على التوالي: الجرائم الواقعة على الإدارة العامة الجرائم الواقعة على الثقة العامة.
