في الجزء الثاني من كتاب "شرح قانون الإجراءات الجزائية العُماني" يتناول الدكتور طارق أحمد ماهر زغلول (المحاكمة وطرق الطعن في الأحكام) وتنقسم هذه الطرق وفقاً للمؤلف إلى طرق عادية وطرق غير عادية، وطرق الطعن العادية وفقاً لما ورد بقانون الإجراءات الجزائية العُماني هو المعارضة والإستئناف ... وتتمثل الطرق غير العادية في الطعن بالنقض أمام المحكمة العليا والتماس إعادة النظر، وتأتي هذه الصفة في خصوص الطعن بالنقض من أن هذا الطريق قد شرع لإصلاح ما يقع في الأحكام من الأخطاء المتعلقة بالقانون ...
وفكرة الطعن في الأحكام جاءت للتوفيق بين اعتبار الثبات والإستقرار في الأحكام من جهة وبين اعتبار إزالة الخطأ من جهة أخرى، وبذلك تُعتبر طرق الطعن من الوسائل القضائية الإختيارية التي ينظمها القانون لمصلحة المحكوم عليه إذا أراد الإعتراض على الحكم الصادر ضده بقصد إلغائه أو تعديله أو إزالة آثاره، وتستعمل هذه الرخصة في صورة طرق معينة حددها القانون ويُطلق عليها طرق الطعن في الأحكام، وهي مجموعة إجراءات تستهدف إعادة موضوع الدعوى على القضاء، أو تستهدف الحكم ذاته، وذلك ابتغاء إلغائه أو تعديله. فكيف أورد المشرّع العُماني طرق الطعن في الأحكام، وفقاً لما ورد بقانون الإجراءات الجزائية العُماني هو ما سيتم شرحه في هذا الكتاب.
