يدور موضوع الكتاب حول الحماية القانونية لبراءة الإختراع والتعديلات التي أدخلتها إتفاقية (التريبس) على براءة الإختراع وانعكاساتها على الدول النامية والمتقدمة على حد سواء.
تعتبر الدول المتقدمة أن الحماية لا يجب أن تكون مرتبطة بقانون دولة معينة، بل يجب اتسامها بالعالمية، على أساس الحق الطبيعي للمخترع. وهنا يُثار التساؤل عما إذا كانت إتفاقية التريبس قد أبقت على ذات نطاق الحماية التي كانت توفره إتفاقية باريس، أم أنها عدلت من نطاق الحماية إتساعاً أو تضييقاً؟.
وفي ظل وضع شروط لمنح إختراع براءة ما، ماذا يكون عليه حال باحثي الدول النامية الذين لا يتوافر لديهم الحد الأقصى من البحث والتطوير ورؤوس الأحوال المطلوبة للتوصل إلى اختراع يستأهل الحصول على البراءة. وهل وضعت إتفاقية التريبس فقط لتنسجم مع مصالح الدول المتقدمة؟ ولماذا تركت المواد المتعلقة بالتراخيص الإجبارية والإستنفاذ الدولي موضع شك وغموض، مع أنه يمكن للدول النامية الإستفادة منها؟ وكيف يمكن الإطمئنان إلى آلية تسوية المنازعات إن كانت ترهق الدول النامية بأحكام الإنفاذ، ولا تنصفها في المشاركة العادلة في نظام تسوية المنازعات؟
