تعد اتفاقية تربس أحد أهم الاتفاقيات الرئيسية في منظمة التجارة العالمية من حيث أنها تعالج موضوعًا هامًا على الصعيد العالمي، والمتمثل في الجوانب التجارية من حقوق الملكية الفكرية لأجل هذا قامت هذه الاتفاقية باستحداث أحكام جديدة لم تنظمها الاتفاقيات الدولية من قبل، طورت بعض الأحكام السابقة وقامت بترسيخها على المستوى الدولي. والجزائر- على غرار باقي دول العالم- تحاول الانضمام إلى منظمة التجارة العالمية هو ما دفعها بأن تقوم بحركة تشريعية مست كل جوانب الملكية الفكرية.
ولكن بما أن اتفاقية تربس كما هو معلوم ما هي إلا مجموعة أحكام قامت بصياغتها الدول المتقدمة وعلى رأسها الولايات المتحدة الأمريكية مستمدة ذلك من مجتمعاتها وخصوصياتها، فدخول دولة كالجزائر وانضمامها لأحكام هذه الاتفاقية قد يصطدم لا محال مع قواعدها وأنظمتها القانونية، خاصة وأن الاتفاقية توجب على الدول المنظمة إليها التقيد بأحكامها الإلزامية، التي يجب أن تتبناها الدولة بدون زيادة أو نقصان.
وتتمحور إشكاليات البحث حول جملة من المحاور وهي: ما مدى موافقة التشريع الجزائري الخاص بالعلامات مع ما جاءت به اتفاقية تربس؟ إلى أي حد استطاع التشريع الجزائري مواكبة التطورات التشريعية الحاصلة في العالم وإلمامه بكافة المستجدات المتعلقة بالعلامات التجارية؟ ما مدى التقارب بين التشريعين الجزائري والمصري خاصة في مجال تشريعات العلامات التجارية؟
