شرعية الاختلاف قضية مهمة وحساسة ومطروحة الآن على بساط البحث سلباً وإيجاباً. يتناول هذا الكتاب القضية في الاختلاف؛ كيف كانت مواقف مفكرينا القدامى من الآخر أو المناقض؟ وكيف تعاملوا فكرياً معه، وكيف جادلوه؟ وهل تحصَّل من هذا كله رصيد يمكن أن يسند الدعوى الآن إلى مشروعية الاختلاف في الرأي، وإلى ترسيخ قواعد الحوار وتقاليده؟. وتطرق علي أومليل في بحثه هذا إلى نوعين من الاختلاف: اختلاف داخل المعتقد الواحد وهذا الاختلاف يكون في مستوى التأويل لنصوص واحدة، إلا أنها تؤدي إلى تعدد المعنى، تؤدي إلى تأويلات مختلفة تقام عليها أنساق من المذاهب. إلى جانب ذلك الاختلاف عرض المؤلف إلى نوع آخر من الاختلاف: اختلاف مفكري الإسلام مع الأطراف المناقضة لهم، أي اختلاف بينهم وبين الذين هم خارج دائرة المعتقد المشترك تناول المؤلف هذا البحث على ضوء التراث الثقافي الإسلامي العربي، ينقب فيه ويحلله، ليرى ما إذا كان مساعداً أو عائقاً على تكوين عقلية قابلة مشرعية الاختلاف. وفي هذا تكمن الغاية من هذا الكتاب.
يتناول هذا الكتاب قضية الاختلاف: كيف كانت مواقف مفكرينا القدامى من الآخر المختلف أو المناقض؟ وهل تحصل من هذا كله رصيد يمكن أن يسند دعوانا الآن إلى شرعية الاختلاف في الرأي، وغلى ترسيخ قواعد الحوار والديمقراطية؟
إن حديثنا عن الاختلاف يتجه إلى عمق الديمقراطية. ذلك أن النظام الديمقراطي يسلم بالاختلاف، ويشرع له، ويبني عليه.
فالاختلاف ليس تفتيتاً وتجزئة، بل هو بديل عن كل استبداد مغلف بغلاف "الوحدة" حين تكون هذه الأخيرة مجرد تغطية لا دعاء امتلاك الحقيقة، والانفراد بالسلطة.
الحق في الاختلاف تضمنه مؤسسات وممارسات وتقاليد، وهو قبل هذا كله يتوقف على الكيفية التي تكونت بها عقلية معينة. لذا رجعنا إلى تراثنا ننقب فيه ونحلله، لنرى ما إذا كان مساعداً -أو عائقاً- على تكوين عقلية قابلة بشرعية الاختلاف. تلك هي الغاية الأساسية من هذا الكتاب.
