أدى التطور التقني المعاصر عبر الفضائيات وشبكات الاتصال مثل الإنترنت الى الربط بين أرجاء المعمورة وتفاعل وتكامل الاقتصاديات الدولية والاتجاه نحو العولمة وهيمنة منظمة التجارة العالمية واتساع مجال اتفاقية الجات والتحول من الاقتصاد الموجه الى الاقتصاد الحر، كان لكل ذلك تأثيره البارز على علاقات العمل في الداخل والخارج، وتزايد دور منظمة العمل الدولية في توحيد مستويات العمل ووضع معايير دولية جديدة تتناسب مع النظام العالمي الجديد وتحقيق التوازن بين حرية التجارة وحقوق العمال.
كان من الطبيعي أن يتدخل المشرع ليعيد علاقات العمل بإصدار قانون العمل الجديد لمواكبة ذلك التطور ومراعاة الاعتبارات السابقة ومحاولة التوفيق بينها رغم صعوبات ذلك في كثير من الأحيان، مما ينعكس على صياغة النصوص من جهة وتناسق الأحكام من جهة أخرى.
