Book Description
تمتاز بعض الموضوعات بأهمية خاصة، لها ما يبررها لإعتبارات كثيرة، خصوصاً تلك الموضوعات التي ترتبط بحساسيات مذهبية ذات طابع خاص، أو ما كان منها يلامس جوهر العواطف والمشاعر البشرية، ويحركها ويثيرها، حيث تتكون روافدها داخل الإنسان، وفي صميم ذاته، وفي عمق تكوينه القريزي والعاطفي؛ وإن موضوع الزواج المؤقت، أو ما يطلق عليه إصطلاحاً "زواج المتعة" يجمع كلتا الناحيتين.
من هنا، كانت لهذا الموضوع أهميته، وحساسيته إلى درجة كبيرة، وهذا النكاح هو: عقد زواج بين الرجل والمرأة، بمهر معين، يُذكر في متن العقد، إلى أجل معين، وبحلول الأجل، أو بهبة الزوج المدة التي بإنتهائها تنحل عقدة الزواج بلا حاجة إلى طلاق.
ولا بد أن تتوفر في هذا النكاح جميع الشرائط الشرعية من البلوغ، والعقل، والإختيار... إلخ، مع عدم وجود مانع شرعي من نسب، أو سبب، أو رضاع، أو إحصان، أو عدة لآخر، أو كونها أخت زوجة، أو نحو ذلك.
هذا بالإضافة إلى توفر سائر شرائط النكاح الدائم، حسبما هو مقرر في الكتب الفقهية، وولد المتعة يُلحق بأبيه، ويرثه كسائر أولاده، وتشمله جميع العمومات الشرعية الواردة في الآباء والأمهات، والأخوة والأخوات، والعمات، والخالات... إلخ.
وحيث أن ثمة كلاماً في بقاء مشروعية هذا الزواج، بعد الإتفاق على أنه كان قد شُرِّع في عهد رسول الله صلى الله عليه وسلم، كان لا بد من التعرض لهذا الأمر، لقطع وابر الخلاف فيه، فلا يتهيب الباحثون الخوض في موضوع كهذا، وذلك لأن الضرورة تحتم معالجته، والخوف فيه، وبيان الصواب والخطأ فيما يتردد حوله.
من هنا، تأتي اهمية هذا الكتاب بأجزائه الثلاثة ليعالج هذا الموضوع الذي تم تقسيمه إلى خمسة أقسام، شمل الجزء الأول قسمين، دار الأول حول زواج المتعة بين التشريع ودعاوي النسخ، وجاء القسم الثاني حول النسخ في الأخبار والأقوال.
أما الجزء الثاني فقد اشتمل على القسم الثالث الذي حمل عنوان: "زواج المتعة ثابت... غير منسوخ"، وضم الجزء الثالث القسمين: الرابع والخامس دار القسم الرابع حول ما جاء في تحريم زواج المتعة، وأما القسم الخامس فقد جاء النقاش فيه حول ما دار بصورة عامة حول زواج المتعة، وما ورد من آراء وأفكار، وجاء هذا القسم تحت عنوان "إن دين الله لا يصاب بالعقول".
