إن حماية الطفل في بطن أمه ورعاية الأم حق كفلته القوانين المختلفة في دول العالم كافة، وتناوله الأطباء والفقهاء والمهنيون كلٌ من تخصصه. كذلك، وضعت الشريعة الإسلامية الكثير من الأحكام بخصوص ذلك، يتعلق بعضها بالطفل قبل الولادة، ومنها منع (الإجهاض) الذي يعد من أكثر مظاهر التجاوز والاعتداء على الجنين، وأكثر خطورة على صحة الأم الحامل والجنين معاً.
وعليه فقد تكونت الدراسة الموسومة (الإجهاض في القوانين العراقية) من مقدمة وثلاثة فصول ومجموعة من النتائج والتوصيات والمقترحات.
تناول الفصل الأول (تحديد المفاهيم والإطار المنهجي للدراسة) في مبحثين، تطرق المبحث الأول إلى تحديد المفاهيم، مثل (الإجهاض، والإسقاط، والجنين، والقوانين العراقية). وتطرق المبحث الثاني إلى الإطار المنهجي للدراسة الذي تضمن أسباب اختيار الموضوع، ومنهج الدراسة إلى غير ذلك..
وتناول الفصل الثاني: أركان الإجهاض وأنواعه ووسائله وما يتعلق به، أما الفصل الثالث فخصص للمواد القانونية الخاصة بالإجهاض في القوانين العراقية، ومنها الإجهاض في قوانين العراق القديم، والإجهاض في قوانين العراق الحديث. ثم جاءت نتائج الدراسة والتوصيات والمقترحات، كل ذلك يأتي بهدف إيجاد بعض الحلول للمواد القانونية الخاصة بالإجهاض.
