إن موضوع هذه الدراسة هو أصول المحاكمات المدنية وهو موضوع خصص له المشرع الأردني قانوناً مستقلاً هو قانون أصول المحاكمات المدنية، والواقع انه ليس هناك تطابق بين ما يتناوله هذا القانون من مواضيع وترتيبها وبين ما يتناوله الفقه بالدراسة تحت عنوان المرافعات، ولا تتفق التشريعات على تسمية موحدة، فبعض التشريعات تجعل التسمية (قانون المرافعات المدنية والتجارية) مثل المشرع المصري، وبعضها يسميه بــ(قانون أصول المحاكمات المدنية) مثل المشرع الأردني والمشرع اللبناني، كما لا يتفق الفقه في طريقة تناول هذا الموضوع، حيث يتجه البعض إلى دراسة نظرية الدعوى أولاً ثم إلى دراسة النظام القضائي والإختصاص ثم دراسة الإجراءات فالأحكام، وقد رأينا أن نتناول في دراستنا هذه شرح قانون أصول المحاكمات المدنية في جزئين نخصص لكل جزء كتاباً مستقلاً على النحو التالي: الجزء الأول: التنظيم القضائي والإختصاص والقضاء المستعجل، الجزء الثاني: الدعوى وإجراءات التقاضي والأحكام وطرق الطعن فيها.
والواقع أننا اتجهنا إلى دراسة هذا الموضوع بعد ما لمسناه من الحاجة الماسة إلى كتب فقهية تتخصص في دراسة قانون أصول المحاكمات المدنية الأردني بشكل معمق يمكن أن تصبح معه خادماً للعدالة بخدمة رجال القضاء والمحامين والدارسين لهذا الموضوع، خاصة في ضوء تعديل قانون أصول المحاكمات المدنية الأردني بموجب القانون رقم 14 لسنة 2001 والأحكام الجديدة التي أدخلها هذا التعديل، والتعديلات التي تمت بموجب القوانين المعدلة رقم 26 لسنة 2002 رقم 20 لسنة 2005 ورقم 16 لسنة 2006، إضافة إلى الأخذ بنظام إدارة الدعوى المدنية بإحداث إدارة قضائية تسمى (إدارة الدعوى المدنية).
ويبحث هذا الجزء في التنظيم القضائي والإختصاص والقضاء المستعجل، حيث إن التنظيم القضائي يتضمن البحث في ترتيب المحاكم وتعددها وتنوعها ونتيجة لهذا التعدد والتنوع تثور مسألة توزيع الإختصاص بين المحاكم المختلفة، وحيث إنه يوجد إلى جانب القضاء العادي قضاء مستعجل فيكون من الواجب أيضاً البحث في القضاء المستعجل.
وبناء على ذلك، فإن هذا الجزء تكون من ثلاثة أبواب: خصص الباب الأول منه لموضوع التنظيم القضائي الأردني، والباب الثاني لموضوع الإختصاص والباب الثالث للقضاء المستعجل.
