تهدف الدراسة في هذا المقرر إلى التعريف على قواعد المرافعات والتنظيم القضائي في سلطنة عمان، والتي نحدد عن طريقها أسس التنظيم القضائي، وأشخاص عملية التقاضي، وكيفية اللجوء إلى القضاء وانعقاد الخصومة القضائية ونظرها والحكم فيها. ويتم ذلك من خلال البحث في المبادئ الأساسية للنظام القضائي ثم الحديث عن رجال القضاء وأعوانهم الذين يشكلون عصب عملية التقاضي في أي نظام قانوني. ويلي ذلك التعريف على قواعد اختصاص المحاكم بالدعاوى المختلفة، وتحديد القواعد التي يمكن عن طريقها إسناد الاختصاص بدعوى معينة إلى محكمة ما.
كما تعرض الدراسة بعد ذلك لنظرية الدعوى، وذلك للوقوف على ماهية الدعوى وخصائصها وطبيعتها القانونية وشروط قبولها وتقسيماتها المختلفة ووسائل استعمالها. ثم تلقي الدراسة الضوء على إجراءات التقاضي للتعرف على كيفية رفع الدعوى، وكذلك لبيان إجراءات ومواعيد المرافعات، والقواعد التي تحكم حضور الخصوم وغيابهم أمام القضاء، وكيفية نظر الدعوى وإدارة الجلسات، وما قد يشوب الخصومة القضائية من عوارض تؤدي إلى وقفها أو انقضائها بغير حكم في موضوعها. ويأتي في نهاية المطاف التعرف على الأحكام والأوامر وطرق الطعن فيها.
وعلى أساس ما تقدم، تنقسم دراستنا في هذا المقرر إلى خمسة أبواب رئيسية نتعرض فيها تباعا للنظام القضائي في سلطنة عمان، ثم لنظرية الدعوى، وقواعد اختصاص المحاكم، ونظرية الخصومة، وأخيراً للأحكام والأوامر وطرق الطعن فيها، وذلك كله على النحو التالي:
الباب الأول: النظام القضائي، الباب الثاني: نظرية الدعوى، الباب الثالث: قواعد اختصاص المحاكم، الباب الرابع: إجراءات التقاضي، الباب الخامس: الأحكام والأوامر وطرق الطعن بها.
