عرضنا في الجزء الأول من هذا المؤلف وفي كتاب مستقل لموضوع التنظيم القضائي والاختصاص والقضاء المستعجل، ونتناول في هذا الجزء الثاني من المؤلف الدعوى وإجراءات التقاضي، إذ إنه من المسلم به أن القضاء لا يتعرض من تلقاء نفسه للفصل في المنازعات بين الخصوم، وإنما يتوجب أن يطلب منه ذلك، ويكون هذا الطلب عن طريق ما يسمى بالدعوى، وبمجرد رفع الدعوى تنشأ حالة قانونية وتبدأ إجراءات التقاضي، وتستمر هذه الإجراءات إلى أن تصل إلى نهايتها الطبيعية بصدور حكم في موضوع النزاع والذي هو الغاية التي يسعى إليها رافع الدعوى، ولضمان صحة وعدالة هذا الحكم وموافقته للقانون فقد نظم المشرع طرقاً للطعن في الأحكام، وسوف نترك أمر بحث الأحكام وطرق الطعن لجزء ثالث. قام المشرع، وكما تناولنا في الجزء الأول، بوضع التشريعات المتعلقة بالتنظيم القضائي، وبين أنواع المحاكم المختلفة واختصاصاتها، وذلك بهدف تمكين الأفراد من اللجوء إلى القضاء بصورة منظمة، واللجوء إلى القضاء يكون عن طريق الدعوى، وهناك مجموعة من الإجراءات والقواعد الشكلية المتوجب اتباعها والمواعيد المتوجب مراعاتها، وبذلك فإننا سوف نتناول هذا الجزء في بابين: الباب الأول: نظرية الدعوى. الباب الثاني: إجراءات التقاضي.
