يختص هذا الكتاب بدراسة الجوانب القانونية لعقد الفاكتورنغ (عقد شراء الديون التجارية) طبيعته القانونية وما يتضمنه من أحكام تختلف عن الأحكام العامة للعقود التقليدية.
وبالتعريف عقد الفاكتورنغ هو: التقنية القانونية التي بموجبها تقوم مؤسسة الفاكتورنغ بالحصول من زبونها على الديون التي يحرزها تجاه زبائنه الخاصين، مقابل أجر بأداء عدة خدمات؛ كإدارة وجباية الديون من المدينين مع ضمان دفعها، أو تسديد هذه الديون مسبقاً.
وفي لبنان، لم يتطرق المشترع اللبناني إلى عقد الفاكتورنغ بقواعد قانونية خاصة، وبدأ هذا العقد في الظهور على الأراضي اللبنانية، بعد إنشاء أول شركة فاكتورنغ لبنانية في بداية عام 2000، هي "شركة الفاكتورنغ اللبنانية - سوليفاك ش.م.ل".
يطرح هذا الكتاب جميع المشكلات والتساؤلات القانونية الخاصة بعقد الفاكتورنغ على بساط البحث وخاصة فيما يتعلق بأطراف عقد الفاكتورنغ وحقوقهم وموجباتهم، والقواعد الواجبة التطبيق لحل النزاعات التي قد تنشأ عن تكوينه أو تنفيذه، وما إذا كان من الممكن اللجوء إلى القواعد العامة واعتماد عقد مسمى لتطبيق قواعده على عقد غير مسمى وفقاً للمادة (175) من قانون الموجبات والعقود.
وعليه، توزع الكتاب على قسمين: القسم الأول: المفهوم القانوني لعقد الفاكتورنغ، والقسم الثاني: الآثار القانونية لعقد الفاكتورنغ.
