التحكيم هو لغة العصر الحديث، التي يتحاكى بها أصحاب الحقوق من الأفراد او المؤسسات أو الدولة الناشئة عن تنفيذ او تفسير عقودهم المدنية أو التجارية أو الإدارية بهدف التوصل إلى حل قانوني لها بصورة إختيارية بالسرعة اللازمة والدقة المطلوبة، شرط أن تكون هذه النزاعات قابلة للصلح أو التفاوض بشأنها أمام هيئات التحكيم المختلفة وأجهزتها المتعددة التي أصبحت أكثر دقة وحداثة وتنوعاً، نظراً لتطور الظروف والمراحل، وإنفتاح الدول أكثر فأكثر فيما بينهما، ونظراً للتقدم التكنولوجي والإقتصادي العالمي، وتشابك المصالح وتفاعل الحضارات لا سيما على مستوى التجارة الخارجية، وإنصهار الدول في بوتقة من العلاقات المترابطة، وثورة الإتصالات والمعلومات التي يشهدها العالم الحديث، مما يستدعي الوقوف لحظة تأمل على المستوى القانوني والقضائي، والنظر في مدى مسايرة هذا التطور العالمي بالنسبة لتطور مفهوم التحكيم وأساليبه الحديثة.
لذلك، وبالإستناد إلى ما تقدم، تناول هذا البحث مفهوم التحكيم في العقود المدنية والتجارية والإدارية وأساليبه والآثار الناجمة عنه، وما للقرارات التحكيمية من أثر في النظام القانوني الداخلي أو الدولي، ومدى إمكانية الطعن ببطلان هذه القرارات ونتائجها القانونية والعملية، وإن هذا الموضوع قد أندرج في بابين واسعين.
أما الباب الأول، وهو بعنوان: التحكيم في العقود الإدارية والمدنية والتجارية، وهو ينقسم إلى فصل تمهيدي وثلاثة فصول شبه متوازنة، الباب الثاني: وهو بعنوان: أسباب بطلان القرار التحكيمي وآثاره القانونية، وهو ينقسم أيضاً إلى فصل تمهيدي وأربعة فصول، بالإضافة إلى الخاتمة.
