إن الأسس التي تُبنى عليها الدولة القانونية، تشكّل ضمانة أساسية لحقوق الإنسان والحريات العامة، وفي ظل هذه الدولة، لا يمكن لأحد أن يكون فوق القانون، فحيث أن جميع الأشخاص سواء أكانوا حكاماً أو محكومين، هم متساوون أمام القانون، فسيادة القانون العادل تكون على السلطات والأفراد معاً.
وهذا الكتاب يتضمن دراسة تحليلية لمفهوم الدولة وحقوق الإنسان والأسس التي ينبغي أن تقوم عليها الدولة لكي تُعتبر دولة قانونية وضامنة لحقوق الإنسان، بالإضافة إلى دراسة أهمية النظام الديمقراطي في الدولة القانونية، والعلاقة بين الديمقراطية والتنمية وحقوق الإنسان، والإقتراحات اللازمة لجعل الدولة قادرة على التطبيق الفعلي للنظام الديمقراطي وضمان حقوق الإنسان.
وقد رأينا تقسيم هذه الدراسة إلى أربعة فصول، حيث نبحث في الفصل الأول في مفهوم الدولة وحقوق الإنسان، ونبحث في الفصل الثاني في أنظمة الحكم والدولة القانونية، وسوف نخصص الفصل الثالث للبحث في أسس الدولة القانونية والديموقراطية، أما الفصل الرابع فسوف نخصصه للبحث في أوضاع الديموقراطية وإنعكاساتها على حقوق الإنسان في الوطن العربي.
