يتعرض هذا الكتاب لموضوع من أهم موضوعات القانون الدولي الجزائي، وهو نظام الجزاء الدولي ( العقوبات الدولية ضد الدول والأفراد). فقد استطاع المؤلف الدكتور علي جميل حرب أن يحدد أسس نظرية عامة للجزاء الدولي. فالمؤلف تتبع تطور الجزاء الدولي منذ الإرهاصات الأولى لهذا الفرع الهام من فروع القانون الدولي العام وحتى يومنا هذا. وثبت لدى المؤلف، وبعد بحث عميق ودقيق أن الجزاء الدولي كان في أول عهده يصدر عن الدول فرادي أو مجتمعة لتوقيعه تجاه الغير وهو سماه جزاء الدول. ثم تطور بعد ذلك إلى جزاء ميثاقي بدءاً من صدوره في اتفاقيات دولية ثناءية وجماعية، مروراً بميثاقي عصبة الأمم ومنظمة الأمم المتحدة وأخيراً في نظام روما المتضمن إنشاء المحكمة الجنائية الدولية الدائمة.
ويبين المؤلف، كيف أن تطبيقات الجزاء الدولي المتقن أعادته الى بداياته الأولى ولكن في ثوب شرعي ميثاقي، حيث عرض وبعد تحليل أمين ودقيق للأوضاع الدولية الراهنة بعد زوال الثنائية القطبية وسريان سطوة الأحادية القطبية. وانتهى من تحليله العميق والموضوعي الى الإعلان بأن الجزاء الدولي المعاصر هو جزاء الدول على وجه الخصوص ما تفرضه الزعامة الأحادية ولكن بغطاء ميثاقي. استخلص ذلك عن طريق البحث العلمي الدقيق للتطبيقات الجزائية العملية المعاصرة ضد بعض الدول: ليبيا، هايتي، السودان وأفغانستان، أو تلك الجزاءات الإنتقائية لمنع انتشار أسلحة الدمار الشامل ضد كل من كوريا الشمالية والجمهورية الإسلامية الإيرانية.
وتوصل المؤلف الى أن تطبيق الجيل الجديد من قرارات مجلس الإمن الجزائية أرست ثلاثة أنظمة جزائية سلبية ما تزال سارية حتى اليوم: 1) نظام الحصانة الميثاقية (الفيتو) الموسع ("اسرائيل")، 2) ونظام الأمر الرديف للإعفاء من المساءلة الدولية الجزائية (قوات السلام الدولية، 3) ونظام الغطاء الشرعي لانتهاكات القواعد الدولية الآمرة (يوغسلافيا السابقة، العراق، أفغانستان...)
ونعتقد أن هذا الكتاب يعَد الأول في تخصيصه حيث سدَ فراغاً كبيراً في المكتبة القانونية الجزائية.
