برز نظام الإسترداد للمطلوبين كحاجة وطنية للدول لإنفاذ عدالتها الجزائية، وكضرورة وطنية سيادية لحماية رعاياها ومصالحها، وكمظهر تعاوني من المظاهر الأساسية للتعاون الدولي في مكافحة الجريمة والحد من فرار مرتكبيها من العقاب.
نعايش ثورة علمية ومعلوماتية، وفائضاً مذهلاً بالتكنولوجيا جعلت مجتمعاتنا فسيفساء بصرية وسمعية مكشوفة لا تعترف بالمفهوم السيادي لحدود الدول الجغرافية، وقد أدى سوء استخدام هذه الثورة وذلك الفائض إلى ظهور جرائم مستحدثة تتجاوز بأضرارها الجرائم التقليدية، لطبيعة تداخل العنصرين الوطني والدولي فيها، مما أوجب على الدول مكافحتها والحد من انتشارها المتنامي، وذلك لعجز دولة بمفردها عن التصدي لهذه الجرائم الوافدة، فكان لنظام الإسترداد للمطلوبين المعاصر الصدارة في التصدي للجرائم التقليدية والوافدة ولمرتكبيها.
والنظام، ورغم بلوغه البناء القانوني الموضوعي والإجرائي، إلا أنه لم يتحرر من تسلط السلطة التنفيذية المناط بها حصراً القرارات النهائية بقبول أو رفض التسليم.
أبحرنا بالتوثيق سنداً للإتفاقيات العربية، وإلى قوانين الإسترداد السائدة في دول ثلاث: الإمارات العربية المتحدة (الخليج العربي) والجزائر (المغرب العربي) و لبنان (المشرق العربي) لنتمكن من الإضاءة على ايجابيات النظام وإشكالياته الوضعية، وعوائقه التطبيقية، واجتهدنا بإقتراحات لتجاوز ثُغَر سريانه العملي.
