تعد العلاقة الإيجارية من أهم العلاقات في كافة المجتمعات على نحو لا غنى للإنسان عنها، ولمّا كانت هذه العلاقة تعاني كثيراً من الإضطراب نتيجة عدم توازنها.
انصبت هذه الدراسة على بيان مدى تحقق التوازن القانوني في هذه العلاقة من عدمه من خلال بيان أحكامها ومعرفة مواطن الخلل فيها، التي تنسحب بالضرورة على عدم توازنها وإضطرابها، بما يؤدي إلى إنشغال المشرّع والقضاء بها، فضلاً عن ذلك أنّ هذا الأمر يؤدي إلى عدم إستقرار شريحة واسعة من المجتمع، وهي شريحة المؤجّرين والمستأجرين، ولم يكن الهدف من هذه الدراسة وضع شرح لأحكام عقد الإيجار، وإنّما عمل المؤلف على تقديم الحلول التي يراها كفيلة بإستقرار هذه العلاقة وسط الأزمة المتنامية للسكن، ولمّا كان المشرع بيني أحكامه في ضوء الواقع السياسي والإقتصادي والإجتماعي في البلاد، عمل على إستلهام الوضع السياسي المتدهور والحال الإقتصادي المتدني والواقع الإجتماعي المتأزم في أغلب البلدان.
وتجسدت منهجية هذا الموضوع بالتحليل والمقارنة، إذ اشتملت على مقارنة القانوني المدني العراقي بالقانون المدني المصري والسوري والليبي والأردني واللبناني والفرنسي، فضلاً عن إجراء المقارنة بين قوانين الإيجارات الخاصة.
كما جاءت هذه الدراسة بواقع أربعة فصول هي: الفصل الأول: التوازن القانوني في الأجرة، الفصل الثاني: التوازن القانوني في المدة، الفصل الثالث: التوازن القانوني في إلتزامات المؤجر، الفصل الرابع: التوازن القانوني في إلتزامات المستأجر.
