خصصت هذه الدراسة لبيان الدور المهم الذي تلعبه المدة في عقد الإيجار، فالمدة في عقد الإيجار ركن لا يتم الإنتفاع ولا يعقد العقد بدونها، وهي فترة زمنية تقاس بها المنفعة في عقد الإيجار، وللمدة خاصية الإستمرار والتعاقب وبهذا الإستمرار وذلك التعاقب يتحقق إنتفاع المستأجر بالمأجور، وهي واحدة في عقد الإيجار لا متعددة أو متجزئة وإنما هي مستمرة ومتعاقبة وبإمتدادها وبمضي الوحدات الزمنية التي تمثل المدة يتحقق إنتفاع المستأجر بالمأجور، وبذلك لا يضع المؤلف شرحاً أو تعليقاً لعقد الإيجار وإنما هدفه هو إبراز الدور الذي تلعبه المدة من خلال هذا العقد.
وقد جاءت هذه الدراسة تحليلية حيث اشتملت على مقارنة القانون المدني العراقي بالقانون المدني المصري والسوري والليبي والأردني واللبناني والفرنسي، فضلاً عن إجراء المقارنة بين قوانين الإيجارات الخاصة.
كما تأتي أهمية الدراسة من خلال تقديم الحلول والمقترحات والتعديلات المتعلقة بالمدة بما يحقق التوازن بين طرفي العلاقة الإيجارية، لا سيما وأن الدراسة ستتضمن تقديم الحلول لمعالجة أزمة السكن وهي المشكلة التي تشغل المشرع والقضاء وشريحة واسعة من المجتمع، فضلاً عن معالجة بعض نصوص القانون المدني وقوانين الإيجار الخاصة بما يحقق التوازن بين المتعاقدين.
وقد اقتضت طبيعة هذه الدراسة أن تأتي بواقع أربعة فصول: الفصل الأول: تحديد المدة في عقد الإيجار، الفصل الثاني: تعديل المدة في عقد الإيجار، الفصل الثالث: إنقضاء المدة في عقد الإيجار، الفصل الرابع: إنقضاء المدة الممتدة قانوناً.
