يتنازع موضوع الصياغة الدستورية بين فرعين مستقلين من فروع القانون: أولهما: علم أصول القانون أو المبادئ العامة للقانون، وثانيهما: القانون الدستوري، ويرجع هذا التنازع إلى وجود العديد من التقنيات والمبادئ المشتركة بين الصياغة . التشريعية من جهة والصياغة الدستورية من جهة أخر ومن ثمَّ تنبع أهمية دراسة هذا الموضوع من عدة نواحي: أولها: أنها تعطي صورة للقارئ والمتخصص عن مفهوم الصياغة الدستورية ونطاقها وأنواعها.
وثانيها: أنها تسلط الضوء على التقنيات التي يسير عليها الصائغ الدستوري أثناء كتابة نصوص الدستور، يستوي في ذلك بالنسبة إلى المراحل السابقة على الصياغة، والمتمثلة في تحديد الخيارات المتاحة، والنهج الذي ستسلكه السلطة المؤ سسة أو لجنة كتابة الدستور بخصوص وضع الدستور وصياغة مواده وتبويبها. وكذلك الحال بالنسبة إلى المراحل المعاصرة لعملية الصياغة الدستورية بمعناها الضيق، من حيث تبيان أوجه القوة والكمال التي يتوجب انتهاجها عند صياغة النصوص الدستورية، وتفادي العيوب والمثالب المرافقة لهذه العملية.
